The topic of the thesis is agency employment. Due to its flexibility and the current situation on the Czech labour market struggling with a labour shortage, agency employment is a frequently used and necessary part of the Czech legal system. In the Czech legal regulation of agency employment, however, we find a number of problematic areas, as a result of which, among other things, the rights of employees temporarily assigned by employment agencies may be jeopardized and insufficiently ensured, or, on the contrary, entrepreneurs operating employment agencies may be unnecessarily burdened. The main goal of this diploma thesis is to describe the problematic aspects of the Czech legislation in the field of agency employment with an emphasis on the legal regulation of the establishment and operation of employment agencies and selected frequently violated or problematic obligations in the field of agency employment relations, in relevant cases to compare these problematic aspects with foreign legal systems and propose a possible corresponding amendments to the Czech legislation. Title of the thesis: Temporary agency employment Abstract The topic of this diploma thesis is temporary agency employment. Temporary agency employment is a type of employment intermediation realized with the cooperation of three entities - the employment agency, the user undertaking and the temporary agency worker. Based on this institute of labour law, temporary agency workers may be assigned to user undertakings to work there temporarily. Temporary agency employment is a popular way of recruiting a labour force, as it provides the possibility to respond relatively quickly and effectively to the need to increase or decrease the number of employees. This work aims to summarise the essential characteristics of temporary agency employment and to point out some problematic aspects of the Czech legislation related to temporary agency employment. The text of this thesis is divided into six chapters. The first chapter deals with employment intermediation and its individual forms. Temporary-work Agencies - Selected Public Law Aspects Abstract Temporary-work agencies (employment agencies) are an important entity in the field of job placement. The topic of this thesis is selected public law aspects of the legal regulation of private employment agencies and their activities, which have not yet received much attention from the professional community, despite the fact that they are essential and often crucial for the activities of employment agencies. The text of the thesis is divided into eight chapters. The first chapter is devoted to the sources of law governing the very existence of private employment agencies, both at the level of international, EU and national law. The second chapter deals with forms of employment intermediation. Attention is also paid to shared employment intermediation and undisclosed employment intermediation. The third chapter deals with the limitations on employment intermediation by employment agencies, both in relation to all forms of intermediation and only to agency employment. Temporary agency work Abstract The theme of this thesis is temporary agency work. Temporary agency work has been a part of the global conversation on flexible employment for most of the 20th century. Now, thanks to the labor market changes and the changes in the attitude toward "atypical work", it's becoming more relevant than ever. The main objective of the legislative efforts related to temporary agency work on global, European and national level is to find the right balance between the necessary flexibility and protection for temporary agency workers. Temporary agency work is a relatively new institute to the Czech legal system and as a result of that, the national legislation is still developing. This thesis is divided into four chapters that are, except for chapter two, focusing on the current legislation of temporary agency work in the Czech Republic. The first chapter provides a definition of temporary agency work and classifies it as "atypical work". It also points out its place in the Czech legal framework as a form of employment intermediation.
